SUMMARY: The position of Attorney General shall be responsible for protecting all Tribal assets, defending the integrity of the Tribe, assisting and advising all Tribal entities in their pursuit of progress on behalf of Tribal members, and managing and providing legal services and representation to the Tribe, the Tribal Council, the Tribal Government, and its Tribal Entities. The Attorney General is prohibited from offering legal advice or representing private individual members, but instead serves to protect the rights of all members of the Omaha Tribe administering fair and impartial justice.
QUALIFICATION REQUIREMENTS: To perform this job successfully, an individual must be able to perform each duty satisfactorily. EDUCATION and/or EXPERIENCE: Must have a Juris Doctorate degree, and have five (5) years of experience as a practicing attorney. At least three (3) years of working responsible legal experience in Indian law, which includes trial practice, government and municipal law, civil rights, land use, corporate and business law, gaming law, real estate law, tax law, and civil legal services is preferred. At least three (3) experience with tribal business entity formation and regulation is preferred CERTIFICATES, LICENSES, and/or REGISTRATIONS: Must pass background check and pre-employment drug screen. Must be admitted to the bar of any state or the District of Columbia. Must be a member of good standing of the Nebraska State Bar Association OR a member in good standing of another State Bar Association OR must successfully have passed the Multistate Bar Examination of the National Conference of Bar Examiners Must have a valid Driver’s License. And be insurable under Tribal insurance Must be or become a member of the Omaha Tribal Bar Association Must be free of any conviction by any state or the United States for a crime punishable by imprisonment in a penitentiary for a term of one (1) year, or more, or by any foreign government for a crime which would be punishable by imprisonment for a term of one year, or more, if committed in Nebraska, or must have been pardoned for such offense, or have had a conviction for offense overturned, or reversed by a court of competent jurisdiction. Must be available evenings, weekends, and holidays if needed. Must comply with the Omaha Tribe’s Drug Free Policy. KNOWLEDGE, SKILLS, and/or ABILITIES: Must be able to work independently on an operational level. Familiarity with Omaha Constitution, Code and culture preferred, but not required. ESSENTIAL DUTIES and/or RESPONSIBILITIES include the following: Advise Tribal Chairman, Executive Officers, and Tribal Council on all legal matters impacting the Tribe, its Tribal Government, and its Tribal Entities; Prepare and recommend appropriate tribal laws, resolutions, rules and regulations for Tribal Council’s approval; Develop, implement, and regularly evaluate policies and procedures to effectively oversee the legal services provided to the Tribal Government and its Tribal Entities, including, but not limited to, legal review and approval of contracts, agreements, leases, and similar documents; Represent or coordinate the representation of the Tribe in any legal proceeding initiated against Tribal Council, Tribal Government, or any Tribal Entity; Coordinate with Executive Employees to evaluate and make recommendations to Tribal Chairman, Executive Officers, and/or Tribal Council regarding ways to improve the programs and services provided to tribal members, the internal environment of Tribal Government and Tribal Entities for employees, and any other means of advancing the best interests of the Tribe; Engage, evaluate, and coordinate legal services that are deemed necessary and provided by outside legal counsel; Coordinate with the Chief Tribal Officer and Chief Financial Officer to prepare and present an annual operating budget for in-house and outside legal services for approval by Tribal Council at least thirty (30) days before the end of the applicable fiscal year; Issue advisory opinions on legal questions interpreting Tribal law upon request of the Tribal Council, an individual Tribal Council Member, a Tribal official, or an Executive Employee.
